Aloha ‘Āina Seed Company LLC (“AASC”, or “we” or “us”) make no warranties with respect to any products sold by us, including warranties of merchantability, fitness for a particular purpose, or otherwise, whether express or implied by law, course of dealing, course of performance, usage of trade, or otherwise. All products are provided “as is”, and without warranties of any kind, whether express or implied. No warranty shall be created by any statement made by AASC or any of our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, or service providers (each, an “AASC Affiliated Person”) for the advertisement or promotion of any product sold by us.

All products sold by us have been manufactured by other parties. These products may be under warranty by their respective manufacturers against defects in workmanship (or materials) that arise during its intended use. There may be a term limit to any of these manufacturers’ warranties, and these warranties may be invalidated by any misuse of the products.  

The buyer expressly agrees that its use of, or inability to use, any products sold by us is at the buyer’s sole risk. Determining the adequacy of any product for any intended purpose is the sole responsibility of the buyer. In making that determination, the buyer has not relied upon any warranty or representation made by AASC or any AASC Affiliated Person. Any information provided by AASC or any AASC Affiliated Person, whether in oral or written form, relating to any product sold by us, and any information, content, and materials available on AASC’s website are for general informational purposes only.  

AASC’s liability for any damages or penalties arising out of or relating to any cause, including breach of contract, breach of warranty and negligence, with respect to the sale of any products is limited to a refund of the purchase price of the product. This remedy is exclusive.  

In no event will AASC or any AASC Affiliated Person be liable for any penalties or damages, including any incidental damages, consequential damages (including any lost profits or revenues), or special or punitive damages for loss or damage from use of products to any associated equipment, cost of capital, facilities, property or services, bodily or emotional injury or loss of life, shut-down or slowdown costs, spoilage of material, or for any other types of economic loss not herein described arising from the use of a product sold to the buyer by AASC.
